Contempt of court laws do not insulate retired judges from criticism: IHC CJ

Contempt of court laws do not insulate retired judges from criticism: IHC CJ
Chief Justice Islamabad High Court Athar Minallah on Friday rejected a petition filed against the PML-N leaders declaring it non-maintainable and observed that ‘contempt of court’ laws do not apply on criticism of retired judges, even if they retired as chief justice of the country.

A petition had been moved in the IHC seeking contempt of court proceedings against PML-N Vice President Maryam Nawaz and ex-prime minister Shahid Khaqan Abbasi over their statements related to former chief justice Saqib Nisar.

Maryam had held a detailed press conference on Wednesday regarding a recently surfaced audio clip allegedly featuring the retired chief justice allegedly issuing directions to wrongfully convict or detain Maryam and PML-N supremo Nawaz Sharif.

Retired chief justice Nisar has already strongly denied that he issued any extra-legal or illegal instructions in any corruption cases against the Sharifs. He has said the audio clip in question has been fabricated and he is contemplating what kind of legal action he will take against it.

Shahbaz demands legal action against officers involved in Daska
Pakistan Muslim League (N) President and Leader of opposition Shahbaz Sharif wrote to Chief Election Commissioner Sikandar Sultan Raja demanding legal action against officers and staff involved in Daska election fraud.

In a letter to the Chief Election Commissioner by opposition leader Shahbaz Sharif, it was said that legal action should be taken against the officers and staff involved in the Daska election theft, exposing those responsible in the federal and provincial governments who gave illegal instructions.

Shahbaz Sharif demanded that district authorities should be caught for issuing instructions under criminal ambitions, complaints should be filed in court against all officers and staff found involved in Daska elections fraud under Section 191 of the Election Act, punishment under sections 184, 186 and 187 should be initiated against those identified for the criminal activity under section 190.

Moreover, action should be taken against those involved under the authority as per sections 167, 175, 174 and 183.

The League leader suggested that amendments should be made to the Act, Rules, Code of Conduct, and Procedures in consultation with political parties so that there are no irregularities in future like Daska election.

The letter further said that fact finding reports have been issued on NA-75 Sialkot 5 (Daska) by-election in which presiding officers, election staff, DC and DPO Sialkot were found guilty of misconduct and illegal activities.

Shahbaz Sharif said in the letter that those involved in fraud also violated the election process to divert the results in favor of the government, the officers found involved gave illegal orders to the election staff and committed criminal conduct.

The report proved that there were continuous meetings with government officials at their residence.

He further said that he appreciates timely decisions of Election Commission to nullify by-election and suspension of concerned officers including DC and DPO and others involved.

These steps of Election Commission will set a direction to prevent such irregularities and illegal conduct in future.

IHC rejects contempt of court plea against Maryam Nawaz

IHC rejects contempt of court plea against Maryam Nawaz
Islamabad High Court (IHC) on Friday has turned down the contempt of court plea against Pakistan Muslim League-Nawaz (PML-N) vice president Maryam Nawaz and Shahid Khaqan Abbasi.

While announcing the reserved verdict, IHC Chief Justice Athar Minallah declared the petition filed by Advocate Kulsoom as inadmissible. Just a criticism on former Chief Justice of Pakistan (CJP) Saqib Nisar doesn’t come under contempt of court. It’s the responsibility of judges to ensure justice to the sufferers, he added.

The CJ further said that an independent judge never gets affected by some criticism. After retirement, judges are no longer part of any court, therefore, the contempt of court is not for a common man, he remarked.

Athar Minallah also expressed that ex-CJP was bashed in personal capacity.

Earlier in the day, the petitioner said that the derogatory language used against Justice Saqib Nisar comes under contempt of court over which, IHC CJ Athar Minallah remarked that judges are open for criticism.

Remarks about retired officials did not warrant contempt of court charges, even if they were made against a former chief justice, he added.

Previously, the high court had taken notice of revelations leveled by former chief judge of Gilgit Baltistan Rana Muhammad Shamim regarding PML-N leaders Nawaz Sharif and Maryam Nawaz and summoned all the parties and Attorney General Khalid Javed Khan in personal capacity.

Former CJ of Gilgit Baltistan was also served with contempt of court notice.

IHC Chief Justice Athar Minallah remarked, “I trust each and every judge of the court. The judges can also be made accountable and criticized. An environment of disbelief will prevail in society if people stop trusting the courts.”

Athar Minallah told the he had also faced social media backlash. He further directed the journalist to read his story’s headline. The IHC CJ asked where the former judge had notarized this affidavit as it is not part of any record of this court.
