Two MQM workers sentenced to death in Baldia factory fire case

An anti-terrorism court (ATC) on Tuesday handed death sentences to two MQM workers, Abdul Rahman 'Bhola' and Zubair 'Charya', for their involvement in the deaths of over 260 labourers in the 2012 Baldia factory arson incident.

MQM leader Rauf Siddiqui, who had been accused of being involved in the incident, was, however, acquitted by the court for want of evidence, along with Umar Hasan Qadri, Dr Abdul Sattar Khan and Iqbal Adeeb Khanum.

Four others — Shahrukh, Fazal Ahmed, Arshad Mehmood and Ali Mohammad — were handed life sentences for facilitating the crime.

The highly-anticipated decision, almost eight years in the making, was announced today by the anti-terrorism court.

One key suspect, the then in-charge of the MQM's Karachi Tanzimi Committee, Hammad Siddiqui, remains absconding. The prosecution had argued in the case that he was the brains behind the extortion and the arson act.

The special public prosecutor had earlier this month said a decision had been reserved on September 2 after arguments from various parties were completed, with the case pending in various courts for almost eight years.

MQM demanded Rs250 million extortion

According to the prosecution, the factory was set on fire by men affiliated with the MQM because the factory owners had refused to give in to the party’s demands for extortion money.

Arshad Bhaila, one of the owners of the factory, had testified in court that MQM men had asked him to pay Rs250 million or a share of 50% in the factory's profits. He said he had been willing to pay Rs10 million.

Throughout the hearings, the statements of some 400 witnesses were recorded, with the factory owners presenting theirs via video link from Dubai.

Former MQM sector in-charges Abdul Rahman, alias 'Bhola', and Zubair, alias 'Charya', were eventually arrested in the case.

Bhola was arrested back in December 2016 from Bangkok with the help of the International Criminal Police Organization, or Interpol. He had confessed to the crime before a judicial magistrate.

Factory lacked safety standards

Independent opinions suggest that regardless of the cause of the fire, casualties occurred because the factory lacked the basic occupational health and safety standards, while the building design was also flawed.

According to London-based research group Forensic Architecture, which conducted an analysis of the fire using computer simulation, inadequate safety measures at the factory had led to the catastrophic death toll.

The case is based on the findings of the joint investigation team’s report, which states that the incident was that of arson, and that the scene was compromised because of the fire rescue activities and the time-lapse.

The report also disapproved of the previous investigations’ claims of holding an electrical short circuit responsible for the fire incident at the Baldia garments factory.

'We were trapped inside'

"People started screaming for their lives,” the then-20-year-old Mohammad Asif had said as he described the incident. "Everyone came to the window. I jumped from the third floor.”

Employee Mohammad Pervez had said at the time the factory owners "were more concerned with safeguarding the garments in the factory than the workers” and that "a lot of people would have been saved" had there been no metal grilles on the windows.

Another worker, Liaqat Hussain, then 29, had said the blaze engulfed the entire factory "within two minutes".

“The gate was closed. There was no access to get out, we were trapped inside,” Hussain had said.

The massive fire was initially reported to have been caused by a short circuit.

A Pakistani soldier was martyred at a military post in Bajur sector during firing that originated in Afghanistan, the army's media wing said in a statement issued Tuesday.

According to the Inter-Services Public Relations (ISPR), 24-year-old Sepoy Sabir Shah embraced martyrdom due to the firing "from across the border in Bajur sector on Pakistan Army Post along the Pakistan-Afghanistan Border, late last night".

"Pakistan has been consistently raising the issue for border management on other side to avoid use of Afghanistan soil against Pakistan," the ISPR warned.

Earlier this month, the ISPR had said a rise in the "violent incidents on both sides of Pak-Afghan border" was meant to derail the Afghan peace process but vowed that both countries would defeat all spoilers.

The "unfortunate rise in violent incidents on both sides of [the] Pak-Afghan border is meant to derail Afghanistan Peace Process," it had said on Twitter.

"Pakistan earnestly believes that both countries deserve peace and progress. Together we will defeat all spoilers," it had added.

Prospects of peace in Afghanistan after 19 long years of war brightened last month when Kabul started releasing 400 Taliban prisoners labelled by President Ashraf Ghani as a "danger to the world".

PML-Q President Ch Shujaat Hussain Monday said every time Nawaz Sharif came to power he weakened the state institutions.

Reacting to former prime minister’s speech at the All Parties Conference (APC) on Sunday, Shujaat stated the speechwriters have put Nawaz in trouble as the narrative that emerged was that he is against the institutions, not politicians.

The government had also slammed him over his remarks with one of the ministers saying that he has “declared war against nation”.

The PML-N supremo in his first political statement since he left the country in November 2019 for treatment in London lambasted the Prime Minister Imran Khan’s government and alleged that it came to power through the rigging.

"Democratic systems around the world follow the same principle. When public votes are not respected and the verdict is decided even before the elections, then we can guess the extent to which the people of this country are deceived and dodged," Nawaz had said.

"Unfortunately, Pakistan has been a laboratory for such experiments. It is not even taken into account that the democratic structure of the country is destroyed due to such tactics and the public loses faith in the system," he added.

The PML-Q president said in his speech Nawaz mentioned about rigging but forgot to mention rigging done in his favour.

The PML-N supremo said the country has been turned into a laboratory whereas he himself had laid the foundation of this laboratory and in 1990 elections he himself had announced the result at noon whereas the election commission announced the result in the evening.

Reference against Ahsan Iqbal in final phase in Sports City Case: NAB

An accountability court in Islamabad on Tuesday adjourned the Narowal Sports City case against PML-N leader Ahsan Iqbal and others until October 20.

The PML-N leader appeared before the court as it resumed hearing the case instituted against him and others by the National Accountability Bureau (NAB). During the hearing, the bureau’s prosecutor informed the judge that the reference against the accused is in a final phase and would soon be filed before the court.

The court, thus, adjourned the hearing until October 20 with direction for the national graft buster to file the reference at the earliest.

At the previous hearing, Ahsan Iqbal’s lawyer had slammed the bureau saying it had failed to file a reference despite arresting his client. He said the NAB chairman also failed to come up with explanation on delay in filing the reference.

The judge asked the NAB prosecutor to explain as to why the reference against Ahsan Iqbal was not filed yet, to which he replied that the reference was sent to Headquarters for approval and will be filed once it is approved.

Ahsan is accused of using funds of the federal government and Pakistan Sports Board (PSB) for a sports city in Narowal.

NAB had announced to initiate a probe into alleged violation of rules in the construction of the National Sports City project – a day after its inauguration by the then President of Pakistan Mamnoon Hussain.

Foreign Minister Shah Mahmood Qureshi has said the long-standing Jammu and Kashmir and Palestine disputes are the United Nation’s (UN) most glaring failures.

Addressing the 75th anniversary of the UN from Islamabad via video link, he said the people of occupied Kashmir still await fulfillment of the commitment made to them by the United Nations to grant them their right to self-determination.

Referring to the UN role, he said it addressed an historic need to save succeeding generations from the scourge of war; to reaffirm equal and fundamental rights of men and women and nations large and small; and to promote better life in larger freedoms.

Qureshi said that today the UN resolutions and decisions are flouted; international cooperation, especially in the Security Council, is at its lowest; force is threatened with abandon; critical Treaties and Covenants, designed to promote development and protect the globe’s fragile environment, are discarded.

He pointed out that the very forces that led to the Second World War, racism and fascism are taking the shape of rising xenophobia and Islamophobia. “While we have seen enormous international cooperation to combat COVID-19, it has failed to unify humanity as it could have,” he said.

Highlighting Pakistan’s contributions to the world body, he said Pakistan remains an ardent believer in multilateralism and the indispensability of the United Nations and has contributed over 200,000 troops to 47 Missions in 26 countries, losing 157 of our bravest in the process. He said the country has also hosted the largest protracted refugee population.
