Indonesian airlines decides to resume flight operations for Pakistan

The Lion Airlines of Indonesia on Monday has decided to resume its flight operations for Pakistan.

The Indonesian airlines have sought permission from the Civil Aviation Authority (CAA).

The positive policies of the incumbent government to contain coronavirus spread has started yielding results, as after Turkish Airlines Pegasus, Indonesian Airlines, Lion has decided to resume its flight operations for Pakistan.

The CAA spokesperson said that the airlines after approval from the government of Pakistan have allowed the airlines to land its flights in Pakistan.

On August 14, British Airways had also resumed its flight operations for Pakistan.

A British Airways flight carrying over 100 passengers and crew members on board had arrived at Islamabad International Airport from London.

All the passengers of the flight were scanned by a medical team deployed at the airport.

On the occasion, the authorities took extra precautionary measures for the safety of its crew and passengers. The officials of the UK embassy had expressed satisfaction over the measures taken at the airport.

Maryam Nawaz decides not to attend APC

Pakistan Muslim League-Nawaz (PML-N) leader Maryam Nawaz has decided against attending the opposition parties’ All Parties Conference (APC).

Sources privy to the development said that PML-N president Shehbaz Sharif along with party delegation will attend the APC. It was also learnt that the PML-N has informed Pakistan People’s Party (PPP), the hosts of the APC about the development.

The Pakistan People’s Party (PPP) has changed the venue of All Parties Conference (APC) of the Opposition from Zardari House to a local hotel in Islamabad, scheduled to be held on September 20.

The APC is scheduled to be held on September 20 as per the decision of the Rehbar Committee of the Combined Opposition and to be hosted by the PPP.

PPP chairman Bilawal Bhutto Zardari is likely to send the invitation letter to all the opposition parties within next two days for the APC.

The APC in its meeting would decide on the future plan of action as the opposition leaders had already made up their minds on numerous issues the country facing currently.

ByteDance picks Oracle as partner to try to save TikTok U.S : sources

Oracle beat Microsoft in the battle for the U.S. arm of TikTok with a deal structured as a partnership rather than an outright sale to try to navigate geopolitical tensions between Beijing and Washington, people familiar with the matter said.

ByteDance, TikTok’s Chinese owner, had been in talks to divest the U.S. business of its hugely popular short-video app to Oracle or a consortium led by Microsoft Corp after U.S. President Donald Trump ordered the sale last month and said he might otherwise shut it down.

While TikTok is best known for dancing videos that go viral among teenagers, U.S. officials are concerned user information could be passed to China’s communist government. TikTok, which has as many as 100 million U.S. users, has said it would never share such data with Chinese authorities.

Sale negotiations were upended when China updated its export control rules last month, giving it a say over the transfer of TikTok’s algorithm to a foreign buyer. Reuters reported last week that China would rather see TikTok shut down in the United States than allow a forced sale.

On Monday, China’s state-run English television channel CGTN cited sources as saying ByteDance would not sell TikTok’s U.S. operations to Oracle or Microsoft, and would not give the source code for the platform to any U.S. firm.

Under ByteDance’s latest proposal, Oracle would be the firm’s technology partner and assume management of TikTok’s U.S. user data, sources told Reuters on Sunday. Oracle is also negotiating taking a stake in TikTok’s U.S. operations, they said.

The data is currently stored in Alphabet Inc’s cloud.

Some of ByteDance’s top investors, including General Atlantic and Sequoia, will also be given minority stakes in those operations, one of the people said.

PRECEDENT

It is unclear whether Trump, who wants a U.S. technology firm to own most of TikTok in the United States, will approve the deal. The Committee on Foreign Investment in the United States (CFIUS), which reviews deals for national security risk, is overseeing the ByteDance-Oracle talks.

“User data protection and assurances around how the company’s algorithms push content to U.S. users are thoughtful components of a substantive solution, but whether they can change political outcomes is a much more difficult question,” said regulatory lawyer John Kabealo, who is not involved in the talks.

ByteDance plans to argue that CFIUS’ approval two years ago of China Oceanwide Holdings Group Co Ltd’s [OWREAC.UL] purchase of U.S. insurer Genworth Financial Inc offers a precedent for its proposal with Oracle, the sources said.

In that deal, China Oceanwide agreed to use a U.S.-based, third-party service to manage Genworth’s U.S. policyholder data. ByteDance will argue a similar arrangement with Oracle can safeguard TikTok’s U.S. user data, the sources said.

ByteDance and Oracle did not respond to requests for comment. The White House declined to comment.

China’s foreign ministry spokesman Wang Wenbin declined to comment on Monday when asked at a press conference about the TikTok deal, but said TikTok was being “encircled” and “coerced” in the United States into a transaction.

“We urge the U.S. government to provide an open, fair, just and non-discriminatory environment for foreign firms operating and investing in the United States,” he said.

WALMART BLOW

Oracle’s chairman Larry Ellison is one of the tech world’s few Trump supporters. His firm has significant technological prowess in handling and safeguarding data, but no social media experience as its clientele comprises companies, rather than consumers.

Peking University professor of investment Jeffrey Towson said Oracle’s ownership of TikTok’s U.S. operations with access, but not ownership, of ByteDance’s core technology mirrored how many Western companies operate in China.

Earlier on Sunday, Microsoft said it had been informed by ByteDance that the Chinese firm would not be selling it TikTok’s U.S. operations. Walmart Inc, which had joined Microsoft’s bid, said it was still interested in investing, and that it would talk further with ByteDance and other parties.

“This is bad news for Walmart more than anyone else,” said Towson. “Combining TikTok’s entertainment and user engagement with its e-commerce platform was its best shot at catching up” with Amazon.com Inc.

TRUMP’S ORDERS

As Sino-U.S. relations deteriorate over trade, Hong Kong’s autonomy, cybersecurity and the spread of the novel coronavirus, TikTok has emerged as a flashpoint.

Trump signed two executive orders last month targeting TikTok and ByteDance. The first, effective Sept. 20, bans U.S. companies from transacting with them. The second requires ByteDance to sell TikTok by Nov. 12.

Were Trump to agree to ByteDance’s proposed Oracle deal, he would have to rescind his order calling specifically for divestment.

As many as 40% of Americans back Trump’s threat to ban TikTok if it is not sold to a U.S. buyer, a Reuters/Ipsos national poll found last month. Among Republicans - Trump’s party - 69% said they supported the order, though only 32% expressed familiarity with the app.

‘UNTRUSTED’ APPS

The White House has stepped up efforts to purge what it deems “untrusted” Chinese apps from U.S. digital networks. Beyond TikTok, Trump has also issued an order prohibiting transactions with Tencent Holding Ltd’s messenger app WeChat.

Earlier this year, Chinese gaming company Beijing Kunlun Tech Co Ltd sold gay dating app Grindr, bought in 2016, for $620 million after CFIUS ordered its divestment.

ByteDance acquired Shanghai-based video app Musical.ly - whose user base was largely American - for $1 billion in 2017 without seeking CFIUS approval, relaunching it as TikTok the following year. Reuters reported last year that CFIUS was investigating TikTok.

Chief Justice of Pakistan (CJP) Justice Gulzar Ahmed on Monday said the judiciary shall continue to uphold the supremacy of the constitution to foster justice in all circumstances.

This he said while addressing the opening ceremony of the New Judicial Year 2020-21 of the Supreme Court in Islamabad.

The CJP said justice cannot be delivered and fundamental rights of the people cannot be protected unless the judges are fully independent and under no external pressure.

Commenting on coronavirus pandemic outbreak in the country, the top judge said that judicial system was also disturbed due to the outbreak of the pandemic and added that pace of solving cases also decreased.

CJP Gulzar said every judge of the superior judiciary is under solemn oath, inter alia, to discharge the duties honestly to the best of his ability and faithfully in accordance with the Constitution and the law, and, in all circumstances, to do right to all manner of people, according to law, without fear or favour, affection or ill-will.

He said it is not only a privilege to be a judge but a heavy-duty is cast upon judges, even under the oath, to preserve, protect and defend the Constitution, and not allow their personal interest to influence the official conduct or official decisions.

The entire federal Cabinet should apologise for the 'victim-blaming' comments made by Lahore's Capital City Police Officer (CCPO) Mohammad Umar Sheikh, the city's top court remarked in a seething statement on Monday.

In a hearing over a petition to initiate a judicial inquiry over the Lahore motorway gang-rape case, LHC Chief Justice Muhammad Qasim Khan said the government may do so if it wishes and that it is legally possible.

"Read the law and let me know as well under what clause shall the court issue such an order," Justice Khan said. "Don't file petitions just to get them in the news."

The government-appointed lawyer told the court a first information report (FIR) had already been registered and an investigation underway.

To which, the judge responded angrily, asking: "What kind of investigation is this where the CCPO is saying the victim is wrong? A lot of ministers issued distasteful statements," he added, wondering if it was "an investigation or a drama".

Justice Khan slammed the government, as well as Punjab's top brass, saying the "advisors and law ministers are going for photo ops whenever they get a chance".

"Is the law minister some investigation officer that he goes [to press conferences] so that his pictures are taken," he asked. "Later, they post those pictures on social media to show they're 'working'."

The judge sought the relevant committee's notification pertaining to investigation of the Lahore motorway gang-rape case, as well as the latest report on the incident. He also summoned CCPO Sheikh.

"What action has been taken on the CCPO's comments," he asked, to which the government's lawyer said the matter was "being investigated".

"Are you saying the CCPO's comments are being investigated," the judge asked, to which the lawyer responded: "No, the entire matter."

"There should have been strict action to reassure this nation's daughters," Justice Khan said, adding that everyone involved should be called to the court.

"We'll look into the matter then."

'Apologise if my statement hurt anyone'

Shortly afterwards, CCPO Sheikh issued a public apology following a meeting with Punjab Governor Mohammad Sarwar, saying he "neither had any ill-intention nor did I imply anything wrong".

"I apologise if my statement has hurt or offended anyone," Lahore's top cop said. "I apologise to my sister who was subjected to the gang-rape, as well as my sisters, brothers, and all strata of the society."

On the other hand, the key suspect in the Lahore motorway gang-rape case, Abid Ali, continues to remain at large, with police teams conducting raids at different locations to search for and arrest him.

One of the two suspects arrested

Meanwhile, Waqarul Hassan, the other suspect the government of Punjab had identified in the case, surrendered himself Sunday at Lahore's Model Town police station, claiming his brother-in-law was using his mobile phone that wrongly implicated him in the crime.

He also denied involvement in the horrendous crime that has sent shock waves across Pakistan and sparked countrywide protests.

Police said Monday further investigations had suggested that Waqar may indeed not have been involved, adding that a final decision on the matter would be taken after they receive the suspect's DNA report.

Police also dispatched teams to Bahawalnagar and Sheikhupura for the arrest of Shafqat, a name Waqar had claimed that the prime suspect, Abid, used to commit crimes with.

Gang-rape on Lahore motorway

Two robbers had allegedly gang-raped a woman Wednesday night in the presence of her children as her car reportedly broke down on the Lahore-Sialkot motorway in an area in the Gujjarpura police station's jurisdiction.

The woman, along with her two children, was driving to Gujranwala when she was forced to stop at the Gujjarpura section of the motorway after running out of fuel around 1:30am.

While she immediately called a relative for help, she also dialed the Motorway Police helpline 130, from which she reportedly received no response. In the meantime, two robbers approached the car, broke the window, and took the woman and her children to nearby bushes where they allegedly raped her in front of the children.

They also allegedly fled with her purse that had Rs100,000 worth of cash, a bracelet, car registration papers, and three ATM cards.

An official DNA test of Shafqat, a resident of Bahawalnagar who was arrested from Dipalpur, would still be conducted soon, the sources said, adding that the sample taken from him has already matched the one obtained from the rape survivor.

No official conclusive DNA report has been issued yet, the sources clarified.

Other detained suspect denies involvement

The Lahore motorway gang-rape case has sent shockwaves through the entire country and sparked major protests across Pakistan, with many demanding capital punishment for the perpetrators and a conversation on sexual abuse being taken up in mainstream debates.

On the other hand, the prime suspect, Abid Ali, remained at large, and police teams were conducting raids at different locations to search for and arrest him.

Waqarul Hassan Shah, the other suspect the government of Punjab had identified in the case, had surrendered himself on Sunday at Lahore's Model Town police station. He had claimed that his brother-in-law was using the mobile phone that had wrongly implicated him in the crime, adding that he himself was not involved.

It was Waqar who told police that the prime suspect, Abid, used to commit crimes along with an individual named Shafqat.

Police had earlier dispatched teams to Bahawalnagar and Sheikhupura to arrest Shafqat. Abid's brother-in-law and other relatives had also been arrested, they had added.

Punjab Information Minister Fayyaz ul Hasan Chohan, when asked about the delay in the arrest of Abid Ali, compared the case to the 2018 rape and murder of seven-year-old Zainab.

“Even three years ago, when the Zainab rape case happened, it took three months to get hold of the culprits although the province had used all of its powers to get hold of the culprits,”.

The minister said Abid Ali had committed rape for the first time in June 2013 and a first information report (FIR) was lodged against him but he was released after some time during Shahbaz Sharif’s government. He also shared that the forensic report had also been finalised months after his release.

He recalled that police have carried out geofencing of the area and have been working day and night with 28 teams on the case. He also shared that the law enforcement agency was able to identify Abid Ali “within 72 hours”.

“Yesterday, Waqarul Hassan surrendered after the police closely tracked him down. The police should be given credit where it is due,” said Chohan.

Talking about laws regarding protection of women and children, the minister said that there were a lot of laws for the safety of women and children "but they are never implemented”.

“This is my personal opinion, not the government’s stance, but I think the rapists should be punished publicly after fulfilling all legal terms,” said the minister. He added if this does not happen then a speedy investigation and prosecution should be done.
